The petitioner seeks regular bail in connection with Forbesganj (Simraha) P.S. Case No. 161 of 2017, dated 10.03.2017, registered under Sections 272,273,34 of Indian Penal Code and 30(A) of Bihar Prohibition and Excise Act, 2016. The allegation leveled is with regard to the police personnel receiving secret information while they were on patrolling duty, that in the house of the co-accused, wine has been kept for sale. Accordingly, the police party conducted a search and raided the place of occurrence, where they found a person trying to escape from there, and from the aforesaid house, 119 bottles of foreign liquor containing 750 ml. each, kept in ten cartoons were

Learned counsel for the petitioner submits that no recovery has been made from the person of the petitioner. It is further submitted that the petitioner is in custody since 11.03.2017 and has no criminal antecedent.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Araria in connection with Forbesganj (Simraha) P.S.
