JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 379 and other allied Sections of the Indian Penal Code. The accusation against the petitioner is that he along with other accused was forcibly took the promissory note of Rs.3,50,000/- from the informant and also assaulted him but due to timely arrival of the police, the life of the informant could be saved.
Contention on behalf of the petitioner is that coaccused Lalan Kumar has already been granted privilege of bail by this Court and the case of this petitioner stands more or less on similar footing.
Patna High Court Cr.Misc. No.13090 of 2016 (2) dt.31-03-2016 2/2 Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nalanda at Biharsharif in connection with Bihar P.S. Case No.44 of 2016.
