The petitioner apprehends his arrest in Jakkanpur P.S. Case No.247/2017, registered under Sections 324, 386, 406, 420, 467, 468 and 471 of the Indian Penal Code.
The informant filed complaint case on the basis of which the present F.I.R. has been lodged. The informant alleged that the petitioner took Rs. 2, 35, 000/- but paid only Rs.50, 000/-, whereas the petitioner admitted to pay Rs.1, 85,000/- in presence of Panches. When the informant demanded the rest money, the petitioner alleged to have threatened him.
Learned counsel for the petitioner submits that the petitioner is own brother of the complainant. Complainant sold the
Patna High Court Cr.Misc. No.35188 of 2018 (2) dt.04-07-2018 2/2 joint property for which the petitioner filed Title Suit No.28 of 2015 in the court of Munsif, Hilsa and that is why this false case has been lodged.
Considering the fact that petitioner happens to be own brother of the complainant and the petitioner denied to have taken any money from the complainant, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna, in connection with Jakkanpur P.S. Case No.247/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
