Petitioner is not named in the first information report nor anything was recovered from his conscious possession. The name of the petitioner came in the confessional statement of the coaccused persons. Petitioner is languishing in jail custody since 13.11.2015 but up-till now he was not put on test identification parade. No doubt, petitioner carries criminal antecedent of several cases but in the present case, except confessional statement as well as his criminal antecedent, there appears to be nothing against him.

Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Railway
