JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-02-2023 Heard the learned counsel for the petitioner as well as Mr. Shailendra Kumar, the learned APP for the State. The petitioner apprehends his arrest in connection with Pachrukhi P.S. Case No. 55 of 2022, registered for the offences punishable under Sections 399, 402 and 120(B) of the Indian Penal Code and section 25(1-b)a, 26, 27 and 35 of the Arms Act. As per allegation, police arrested some persons on the suspicion that they were planning to commit some serious offence. Some of the miscreants became successful in flee away. Some arms and ammunition were recovered from the possession of the arrested persons.

The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. He was not arrested at the spot. Nothing was recovered from his possession. There is

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Pachrukhi P.S. Case No. 55 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
