JUSTICE PRABHAT KUMAR JHA ORAL ORDER 11-09-2019 Heard Sri Yogesh Chandra Verma, the learned senior counsel for the petitioner, and the learned APP.. The petitioner apprehends his arrest in Excise case No. 215 of 2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

On secret inputs raid was conducted and 8 bags containing bottles of Crazy Romeo, each containing 750 ml and 180 ml liquor, about 165.960 liter, were recovered from the heap of straw kept in front of the house of the petitioner. The learned senior counsel for the petitioner submits that recovery was made outside the house and for that the petitioner cannot be held responsible but it appears that recovery was made just in front of the house of petitioner, which was

Patna High Court CR. MISC. No.56657 of 2019(2) dt.11-09-2019 2/2 intentionally concealed under the heap of straw. The petitioner has got criminal antecedent and he is accused in Excise case No. 88 of 2018.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
