JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 happens to be full brother of the informant whereas petitioner nos. 2 and 3 are nephews of the informant and it appears that due to some family feud the alleged occurrence took place. The informant claimed that he as well as his wife were badly assaulted by the petitioners but from perusal of the impugned order, I find that the learned Additional Sessions Judge-II passed the impugned order on 22.02.2016 without obtaining the injury report as the prosecution failed to produce the injury report before the court below. Patna High Court Cr.Misc. No.18942 of 2016 (2) dt.04-05-2016 2/2 languishing in jail custody since 27.01.2016 and the investigation against them appears to have already been completed. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Karpi P.S.case No. 105 of 2015.
