At the very outset, it is pointed out on behalf of the petitioner that correct name of the petitioner is Persuram Kumar Sinha @ Prashuram Kumar Sinha but at the time of institution of the present case, informant wrongly, mentioned name of the petitioner as Prashant Kumar Sinha @ Persuram Kumar Sinha that is the reason this petition has been filed giving both names.

Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner seeks bail in a case registered under sections 406, 420, 467, 468, 471, 120B and 161 of the Indian Penal Code. It is submitted that petitioner was employee of the concerned company and moreover, coal does not come under the ambit of essential commodity as coal has already been denotified by

Patna High Court Cr.Misc. No.14718 of 2016 (3) dt.11-04-2016 the government.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Barun P.S. Case no. 27/2016.
