The petitioner seek regular bail in connection with Kalyanpur P.S. Case No. 31 of 2017, registered under Sections 272,273 and 34 of IPC and 38 of Bihar Excise Amendment Act. The allegation leveled is with regard to the police receiving secret information that the owner of Prince Line Hotel, namely Ashok Kumar Yadav and Munna Rai are indulging in business of illicit liquor. It is further alleged that when the police arrived at the spot, some people were unloading the cartoons from the truck and loading it in the Scorpio vehicle and on seeing the police the said people fled away, however, some of them were caught.

Patna High Court Cr.Misc. No.27073 of 2017 (2) dt.15-06-2017 2/2 Learned counsel for the petitioner submits that so far as the petitioner is concerned, the police apprehended him by mistake. It is further submitted by the learned counsel of the petitioner that the petitioner has no criminal antecedent and he is in custody since 11.03.2017.

Further submission of the learned counsel for the petitioner is that similarly situated person has already been granted bail by a bench of this court by an order dated 07.06.2017 passed in Cr. Misc. Case No. 25330 of 2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub. Divisional Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 31 of 2017.
