The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420, 409 of the Indian Penal Code.

As per prosecution case, it is alleged that all the F.I.R named accused persons in collusion with other persons have misappropriated the government fund by purchasing sub-standard materials for the purposes of Nal Jal Yojna project of the government. It is also alleged that they made payments to the supplier in advance without proper voucher and the quality of the

Patna High Court CR. MISC. No.65386 of 2021(2) dt.15-07-2022 2/3 materials supplied was not verified by the Junior Engineer prior to its use. It is also alleged that huge amount is said to have been paid to the dealer in advance in connection with materials suplied for the project.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner is proprietor of a Hardware Shop namely Sunita & Sons. The thrust of accusation is against Chairman and Secretary of the ward in question who have been granted privilege of anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 45056 of 2021. Moreover, the Panchayat Secretary has reported to the B.D.O., Bahadurpur to withdraw the F.I.R since the work has been completed. A letter of the Panchayat Secretary has been annexed as Annexure-2 to the petition.

In the facts and circumstance of the case, let the petitioner, above named, in the event of her arrest
