2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 414 and 468 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 1390.2 litres illicit liquor has been recovered from a Tata Sumo vehicle, which was being driven by this petitioner.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated merely because he happens to be driver of the vehicle in question. Nothing has been recovered from the conscious possession of this petitioner.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that huge quantity illicit liquor has been recovered from the vehicle which was being driven by this petitioner. Petitioner has also got one criminal antecedent of similar nature.
6. Considering the aforesaid facts and circumstances, nature of accusation, fact that huge quantity of illicit liquor that has been recovered from the vehicle which was being driven by this petitioner and criminal antecedents, the prayer for grant of anticipatory bail to the petitioner is rejected.
