This petition has been filed for modification of the order dated 17th November 2014 passed in CWJC No. 24061 of 2013 and it is submitted that as no money remained pending with the Bank, the question of paying interest to the petitioner does not arise.

Petitioner was not paid on account of laches on the part of Bank Officials, as the record reached its destination after long lapse of time. Due to fault on the part of Bank Officials

Patna High Court MJC No.827 of 2015 (2) dt.13-01-2016 2/2 petitioner should not suffer.

This Court does not find any substance in the argument of the Bank. Accordingly, this petition is rejected. However, time for payment of the amount, including the interest is extended by further four weeks.
