JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner appears to have been arrested in Mirganj P.S. Case No. 19 of 2015 in which he confessed his guilt and also disclosed his involvement in the present case. It appears that except the aforesaid confessional statement, there is nothing against him. Moreover, even if his confessional statement assumed to be true, then also, he had not taken active participation in the present crime.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.14044 of 2016 (2) dt.05-04-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri G.K. Yadav, Judicial Magistrate 1st Class, Purnea in connection with Banmankhi P.S. Case No. 274 of 2015.
