The petitioner seeks pre-arrest bail in connection with Nayaramnagar P.S.Case No. 20 of 2018 registered under Sections 147, 148, 149, 307, 323, 504, 506, 427 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that a simple case of quarrel between two parties has been given colour of a case of serious nature. The injuries sustained by the informant are simple in nature and that too caused by hard and blunt substance whereas in the FIR just in order to make the offence non-bailable, it has been alleged that the accused persons resorted to firing.
Patna High Court Cr.Misc. No.35922 of 2018 (2) dt.02-07-2018 2/2 Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioner. Considering the nature of allegation, facts and circumstances of the case and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M 1st Munger in connection with Nayaramnagar P.S.Case No. 20 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure (Ashwani Kumar Singh, J) Pradeep/Sneha U T
