Petitioner being the husband of the informant is languishing in custody since 04.10.2015 in a case registered for the offences punishable under Sections 498A, 328, 307/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Basic accusation is of torture for non-fulfillment of dowry demand. It is alleged that the accused persons administered some poisonous medicine to the informant. Learned counsel for the petitioner submits that the accusation of administering poison and torture is omnibus and general. The investigation has already concluded. There is no resisting injury found on the person of the informant.
Patna High Court Cr.Misc. No.13816 of 2016 (2) dt.29-03-2016 Considering the fact that investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri N.K.P. Gupta, Additional Sessions Judge-II, Saharsa in connection with Saharsa (Mahila) P.S. Case No. 58 of 2015.
