JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 414/34 of the Indian Penal Code.

Some accused were arrested and stolen motorcycles were recovered from their possession. The aforesaid co-accused disclosed that they used to sell the stolen motorcycles to the petitioner. Admittedly, no stolen motorcycle has been recovered from possession of the petitioner. So far as criminal antecedent of the petitioner is concerned, it is submitted that petitioner was remanded in several cases by G.R.P. in the year 2010 without any cogent material and moreover, petitioner has already been granted privilege of bail in almost all the cases.

No.14744 of 2016 (2) dt.08-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Mojahidpur P.S. Case No.137 of 2010.
