JUSTICE SANJAY PRIYA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Puraini P.S. Case No. 42 of 2016 instituted for the offence under Section-379 of the Indian Penal Code.
It is alleged in the written report that motorcycle of the informant was looted by unknown person. During investigation, the aforesaid motorcycle was recovered from the kitchen garden of the petitioner.
It has been submitted on behalf of the petitioner that the seizure list does not bear signature of the petitioner. The petitioner is said to be in custody since 29-11-2016. In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
Patna High Court Cr.Misc. No.26949 of 2017 (3) dt.12-07-2017 2/2 sureties of the like amount each in connection with Puraini P.S. Case No. 42 of 2016 to the satisfaction of Sri Shiv Kumar, learned Judicial Magistrate-Ist Class, Udakishunganj, Madhepura subject to condition that both the bailors should be close relatives of the petitioner.
