Petitioner claims that private respondent is making construction over public land of plot nos.1573 and 1565 of Tauzi No.5118 situated opposite Old Lal Kothi, Alkapuri More, Gardanibagh, Patna.

It is also stated that the petitioner has given representation to the Collector, Patna, Municipal Commissioner, Patna as well as the Circle Officer, Patna Sadar but no decision has been taken till date.

Patna High Court CWJC No.14370 of 2015 dt.02-12-2016 2 / 2 Accordingly, this writ application stands disposed of with a liberty to the petitioner to approach the Municipal Commissioner, Patna by filing a proper representation setting forth all the necessary facts and his grievance along with necessary document, if any. On such representation being filed along with a copy of this order then let a decision be taken by the Municipal Commissioner within a period of three months from the date of filing of such representation by the petitioner. However, it is made clear that before passing any order or taking any action, all the concerned parties including the private respondent should be granted reasonable opportunity.
