JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 04-02-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Rosera P.S. Case No. 72 of 2022 registered for offence punishable under sections 427, 323, 504, 506, 379/34 of the Indian Penal Code.

As per allegation, the accused persons including the petitioners came to the land of the informant and they forcibly get it ploughed by tractor, whereby they destroyed wheat crops

The learned counsel for the petitioners has submitted that the informant claims that land to be acquired by him on the basis of registered gift deed by one Mosmat Gauri Israin, whereas the petitioners had obtained that land through sale deed from sister of the father of the informant, namely, Ramdai Devi. As such, there is land dispute and the informant and his family members have also implicated the petitioners in two other cases. FIR has been lodged after 17 days and the allegation is general and omnibus.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Rosera in connection with Rosera P.S. Case No. 72 of 2022, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) Mahesh/- U T
