JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is an accused in Alamganj P.S. Case No.7 of 2016 registered under Section of 414/34 of the I.P.C. The accusation is that on receipt of a secret information about selling of stolen mobiles by a boy at Mehdiganj, the informant along with other police party reached Mehndiganj Railway Station where a boy was apprehended who disclosed his name as Santosh Kumar and on search three mobiles of different companies were recovered from his possession and his house was also raided upon which 18 L.E.D. T.Vs. of different companies were seized. Santosh Kumar confessed that he had sold a number of L.E.D. T.Vs. to co-accused, Pappu Kumar,

Learned counsel for the petitioner submits that the petitioner has not been named in the written report but his name finds place in formal F.I.R. in accused column No.4 and after lodging the present case the house of the petitioner was searched from where stolen L.E.D. T.Vs. were recovered. In fact, he had purchased the same from Santosh Sao who was apprehended by the police and the petitioner is in custody since 9.1.2016 in the present case and similarly situated co-accused Sanjiv Kumar has already been granted bail by another coordinate Bench vide Cr.Misc. No.9702/16 on 1.3.2016.

Having regard to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M., Patna City in Alamganj P.S. Case No.07 of 2016.
