The petitioners seek bail in Bahadurpur P.S. Case No. 75 of 2017 instituted for the offence under Sections 147, 148, 149, 341, 342, 323, 324, 307 and 302 of the Indian Penal Code. It has been submitted on behalf of the petitioners that there is specific allegation of causing injury with dagger against Ram Mohan Paswan and Ram Prit Paswan. It has further been submitted that co-accused Mithu Paswan has already been granted bail by a coordinate Bench of this Court vide order dated 4.7.2017 passed in Cr. Misc. 27040 of 2017.
Patna High Court Cr.Misc. No.27055 of 2017 (4) dt.28-07-2017 2/2 Case diary has been received.
In the post mortem report attached with the case diary, the doctor has found incised punctured wound on the person of the deceased. There is general and omnibus allegation against the petitioners. In the case diary also there is no any specific overt act against the petitioners.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Darbhanga at Laheriasarai in connection with Bahadurpur P.S. Case No. 75 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioners. (Sanjay Priya, J) S.Ali/- U T
