JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Parihar Police Station Case No. 170 of 2012 registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report, but in course of investigation, confessional statement of coaccused Braj Mohan Kumar has been recorded and the said coaccused disclosed that he had some talk with the petitioner prior to the alleged occurrence. It appears that except the aforesaid material as well as tower location of mobile of the petitioner near the place of occurrence, there is nothing against him.

No.30860 of 2014 (3) dt.05-01-2015 2/2 Accordingly, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Parihar Police Station Case No. 170 of 2012, subject to condition as laid down under Section 438(2) of the Cr.P.C.
