This is an application for bail in connection with Ramnagar P.S.Case No. 91 of 2017 registered for the offences punishable under Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.
Allegation against the petitioners is of recovery of huge quantity of arms and ammunitions from their house. It has been submitted on behalf of the petitioners that though four arms have been recovered, condition of only one was found effective in the examination by police and others were found ineffective. Further submission is that they have been falsely implicated in this case because of enmity and they are in
Patna High Court Cr.Misc. No.26764 of 2017 (4) dt.04-08-2017 2/2 custody for more than four months and petitioner No.1 is old person aged 70 years.
Heard learned APP also.
Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioners at this stage. However, petitioners may renew their prayer for bail after framing of charge in this case or after completion of 6 months period in custody, whichever is earlier. With the above observation, this application is dismissed.
