JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Akilpur P.S. No. Case No.23 of 2017, registered for offences punishable under Sections 304-B/201/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the husband of deceased, is of killing the sister of the informant due to non fulfillment of demand of dowry and her dead body was disappeared by the accused persons.

Submission of the learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and other accused persons have been granted privilege of anticipatory bail vide order dated 02.04.2018 and 08.05.2018

Patna High Court Cr.Misc. No.42107 of 2018 (2) dt.19-07-2018 2/2 passed in Cr. Misc. Nos. 7639 of 2018 and 27352 of 2018. Learned A.P.P. opposes the prayer for bail.

In view of the facts and circumstances and from perusal of the impugned order, it appears that there is allegation of demand of dowry and in such view of the matter, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.

With the aforesaid observation, this application is dismissed.
