JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and the state. The petitioner seeks bail in Excise P.S. Case No. 01 of 2017 for offences under Section 30(a) of Bihar Excise Amendment Act, 2016.

Earlier prayer for bail of the petitioner was rejected by this court vide order dated 16-02-2017 passed in Cr. Misc. No. 4975 of 2017 with liberty to renew his prayer for bail after four months.

There is allegation against this petitioner that 200 litres of country-made liquor was recovered from the vehicle, which was driven by the petitioner. The petitioner is in custody since 0101-2017. Keeping in view the period, spent by the petitioner in

Patna High Court Cr.Misc. No.33084 of 2017 (2) dt.19-07-2017 custody, prayer for bail is allowed and it is ordered that the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Excise P.S. Case No. 01 of 2017 to the satisfaction of A.C.J.M. Sherghati, Gaya subject to condition that both the bailors should be close relative of the petitioner.
