The petitioner seeks bail in connection with Kothi P.S. Case No. 38 of 2016, registered under Section 302 & 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner has been disclosed, being an associate, by co-accused Shane Ali Khan, but he has not disclosed about participation of the petitioner in the present case, thereafter, the petitioner, who was in custody in connection with Amas P.S. Case No. 164 of 2016, has been remanded in this case on 26.10.2016 since then he is in custody.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.27661 of 2017 (2) dt.12-07-2017 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-VIth, Gaya in connection with Kothi P.S. Case No. 38 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and further the petitioner shall remain present on each and every date during the course of the trial. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
