JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 Learned counsel for the petitioner is permitted to make necessary correction in the prayer portion of the bail petition. The petitioners seek regular bail in connection with Dhoraiya P.S. Case No. 230 of 2014, registered for offences punishable under Section 395 of the Indian Penal Code. It has been submitted on behalf of the petitioners that they are not named in the F.I.R and they have been made accused in this case only on their self confession and on that basis they have been made accused in two other cases also. Further petitioners have been in judicial custody since 03.06.2016. Learned counsel for the State could not controvert the above submission.
Having heard both sides, in view of the facts as stated above, let the petitioners above named, be released on bail on
Patna High Court Cr.Misc. No.27270 of 2017 (2) dt.12-07-2017 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Banka, in connection with Dhoraiya P.S. Case No. 230 of 2014, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
