JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2017 Sri Rajeev Ranjan, learned counsel for the petitioner, is present. No one appears on behalf of the State. Learned counsel for the petitioner submits that the brother of the petitioner has sworn affidavit specifically stating that there is no criminal antecedent against the petitioner. In this view of the matter, let the defect, as pointed out by the stamp report, be ignored.

Learned counsel for the petitioner prays for hearing of the matter.

The petitioner is seeking regular bail in Muzaffarpur Sadar P.S. Case No. 156/17 registered under Sections 414 and 401

Patna High Court Cr.Misc. No.27288 of 2017 (2) dt.12-06-2017 2/2 of the Indian Penal Code.

A perusal of the First Information Report would show that the patrolling party got some secret information while they were on their duty in connection with one case of theft of a motorcycle. It is alleged that 5-6 persons, on seeing the police team, started running away, however, on chase, police apprehended two boys, namely, Sujit Kumar Rai and Rahul Kumar.

Learned counsel for the petitioner would submit that the name of the petitioner has transpired in the confessional statement of the co-accused, however, no recovery has been made from his possession.

Considering the nature of allegations and that the name of the petitioner has transpired in the confessional statement but no recovery has been made and the petitioner has no criminal antecedent, let the petitioner, namely, Neeraj Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Muzaffarpur Sadar P.S. Case No. 156/17.
