The petitioner apprehends his arrest in Mahua P.S. Case No.94 of 2018 registered under Sections 341, 323, 324, 307, 447, 379, 504/34 of the Indian Penal Code.

The informant alleged that his son was going on a motorcycle but unfortunately the motorcycle touched Bharat Das. The son of Bharat Das threatened the son of the informant. When the accused persons came from Barati they came to the darwaza of the informant and assaulted the son of the informant. The petitioner is alleged to have assaulted the informant with farsa on his head and elbow.

The learned counsel for the petitioner submits that there is a case and counter case. The informant got simple injury.

Patna High Court Cr.Misc. No.34599 of 2018 (2) dt.02-07-2018 From the side of the petitioner, so many persons are injured. Both the sides compromised the case. The accused persons of the counter case has already been granted anticipatory bail by the learned Sessions Judge vide A.B.P. No.941 of 2018. Considering the facts aforesaid that there is a case and counter case and both sides got injuries and the case is compromised, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No.94 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
