JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner is accused in C-2/142/2017 registered for the offences punishable under Section 30(A) of Bihar Excise Amendment Act, 2016.
From the first information report it appears that the petitioner along with Nagendra Mandal was apprehended with 63.78 litres of beer and Nepali wine. The said Nagendra Mandal who was apprehended along with the petitioner was enlarged on bail by this court vide order dated 17.05.2017 passed in Cr. Misc. No. 22642 of 2017.
On the ground of parity, I am inclined to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.27303 of 2017 (3) dt.01-07-2017 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Sitamarhi in connection with C-2/142/2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, influence the witnesses.
