The petitioners seek anticipatory bail in connection with Industrial (Bhagalpur) P.S. Case No. 10 of 2018, registered for offences punishable under Sections 147, 148, 323, 307, 504 and 506 of the Indian Penal Code.

Allegation as per F.I.R. is that the petitioners along with other accused persons intercepted the informant and his wife and started abusing and assaulted them.

Submission of the learned counsel for the petitioners is that the specific allegation of assault by khanti to the informant is against, Madhewa Das and there is general and omnibus allegation

Patna High Court Cr.Misc. No.41873 of 2018 (2) dt.19-07-2018 2/2 against these petitioners.

Heard learned A.P.P., who opposes the prayer for bail. Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Industrial ( Bhagalpur) P.S.Case No. 10 of 2018 to the satisfaction of learned Sub Judge, X-CumAdditional Chief Judicial Magistrate- IX, Bhagalpur, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
