JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(i-B)A/26/35 of the Arms Act.

One country-made pistol containing one live cartridge, three live cartridges and one mobile phone are said to have been recovered from possession of the petitioner, when the petitioner and others were caught along with the victim of a kidnapping case.

Admittedly, the present case has been lodged only for the recovery of aforesaid fire-arms and cartridges. The petitioner is languishing in jail custody since 14-09-2015 and except the present case as well as above-said kidnapping case, there is no any

Moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail by a coordinate bench of this court. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Parbatta (Bhatkhand) P.S. Case No. 283 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Khagaria.
