The petitioner seeks bail in connection with Pirbahore P.S. Case No.30 of 2017 registered under Sections 25(1-b)a and 26 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Patna.
The accusation is that one country made pistol and one live cartridge were recovered from the possession of the petitioner. Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case and he is in custody since 31.01.2017. Further submission is that while the petitioner is accused in nine other cases, as detailed in
Patna High Court Cr.Misc. No.27419 of 2017 (2) dt.12-07-2017 2/2 paragraph-3 to this application, but out of them, the petitioner has already been acquitted in two cases whereas in two cases, police has submitted the final form against the petitioner. Having regard to the facts and the circumstances of the case and the nature of allegation as also considering the criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
