The petitioner apprehends his arrest in Dighwara P.S. Case No.216 of 2017 registered under Sections 366/34 of the Indian Penal Code.
The informant alleged that his wife had gone to Bank to withdraw money but she did not return. His wife rang his mobile that petitioner, Bhola Paswan and Krishna Paswan brought her on one pretext or other and they kept her in the house of their relatives.
The learned counsel for the petitioner submits that the victim was having love affairs with the petitioner and she voluntarily accompanied the petitioner. After sometimes, the victim fled away and statement under Section 164 Cr.P.C. was
Patna High Court Cr.Misc. No.34644 of 2018 (2) dt.02-07-2018 recorded that the petitioner enticed her. He further submitted that the case has been compromised.
It appears that the victim is a major woman and she accompanied the petitioner to different places without any reason. Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Singh, learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Dighwara P.S. Case No.216 of 2017, corresponding to G.R. No.7991 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
