JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks pre-arrest bail in connection with Madhepur P.S. Case No.36 of 2014 registered under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
Regard being had to the fact that though the petitioner was named in the FIR, the police did not find his culpability in the alleged offence and submitted final report against him which was accepted by the jurisdictional Magistrate and he has been summoned by the trial court at a later stage as an additional accused in exercise of power conferred under Section 319 of the Code of Criminal Procedure, in the event of arrest or surrender in
Patna High Court Cr.Misc. No.35233 of 2018 (2) dt.28-06-2018 2/2 the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-VI, Madhubani in connection with Madhepur P.S. Case No.36 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
