Petitioners apprehend their arrest in Sanokhar P.S. Case No.13 of 2019 registered under Sections 341, 323, 354(A), 379, 308, 504, 506 and 34 of the Indian Penal Code. The informant named the petitioners and alleged that on account of previous land dispute, the petitioners came and abused the informant and assaulted him and his wife. Ajay Yadav (petitioner no.3) is alleged to have assaulted the wife of the informant with stick on her leg and also torn her clothes. Sanjay Kumar Yadav (petitioner no.2) snatched Rs.2,000/- from possession of the informant.

Patna High Court CR. MISC. No.56119 of 2019(2) dt.09-09-2019 2/2 Learned counsel for the petitioners submits that on account of land dispute, the case has been lodged. There is counter version. Both sides engaged in scuffle with each other on account of land dispute.

Having considered the facts and the nature of allegation made against the petitioners and the fact that both sides made allegation of assault against each other and there is case and counter case on account of land dispute, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Sanokhar P.S. Case No.13 of 2019 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
