JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending his arrest in connection with Rosera P.S. Case No. 213 of 1996 registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act and later on Section 427 of the Indian Penal Code was also added, seeks the privilege of pre-arrest bail. Allegedly, in this case the police after completing investigation submitted chargesheet only against Manikant Choudhary and, accordingly, cognizance was taken and the case proceeded for trial but during trial only on suspicion, the petitioner has been named and resultantly, he has been summoned under Section 319 Cr.P.C.

Patna High Court Cr.Misc. No.31489 of 2014 (2) dt.30-01-2015 In the facts and circumstances as stated above, the petitioner is directed to surrender in the learned trial court and in that case he shall be released on bail on execution of bail bond to the satisfaction of the learned court below itself.
