The petitioner seeks bail in connection with Hathouri (Shivjee Nagar O.P) P.S. Case No. 26 of 2017, registered under Sections 365 and 366-A of the Indian Penal Code. The accusation is of kidnapping of minor daughter of the informant by the petitioner in connivance with other accused named in the F.I.R.

Learned counsel for the petitioner submits that the victim, minor daughter of the informant, was found on the road after three days of the alleged occurrence and her statement under Section 164 Cr.P.C. was recorded in which she has stated that her uncle had given threatening to implicate the petitioner due to that reasons, she had gone to the house of her aunt and she

Learned counsel appearing on behalf of the informant submits that the age of the victim has been assessed between 14-15 years at the time of occurrence. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) two sureties of the like amount each to the satisfaction of the ACJM-II, Rosera, Samastipur in connection with Hathauri P.S. Case No. 26 of 2017.
