JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366 of the Indian Penal Code.
The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she stated that she was taken away by the petitioner after putting her into fear and thereafter, she was confined in a room and petitioner used to have sex with her and also forced her to solemnize marriage and subsequently, petitioner solemnized his marriage with her in a temple but anyhow she got opportunity to elude from the clutches of the petitioner and gave information to her father who along with police officials came and recovered her.
Patna High Court Cr.Misc. No.15034 of 2016 (2) dt.12-04-2016 2/2 Contention on behalf of the petitioner is that the victim was in love with petitioner and as a matter of fact, she deserted her husband and pressurized the petitioner to solemnize marriage and after that petitioner solemnized his marriage with the victim but subsequently, when the victim came under the clutches of her father, she took U-turn. It is further contended that victim was major at the time of alleged occurrence.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhagwanpur P.S. Case No. 14 of 2016.
