Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code.

As per the prosecution case, petitioner No. 1 is alleged to have assaulted the father of informant with iron rod on his head and petitioner No.2 snatched wrist watch worth Rs. 1600/- from the informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. Injuries are reported to be simple in nature. Petitioners

Patna High Court CR. MISC. No.65924 of 2021(2) dt.14-07-2022 2/2 have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the fact that there is specific allegation against petitioner No.1 of assaulting the father of informant by means of iron rod on his head, his prayer for anticipatory bail is refused.

Considering the facts of the case and clean antecedent of the petitioner No.2, let the petitioner No.2, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateIV, Madhepura in connection with Kumarkhand PS case No.70/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
