Petitioner seeks regular bail in connection with Sessions Trial No.114 of 2016, corresponding to Saharsa P.S. Case No.169 of 2006 registered for the alleged offences under Sections 302, 34, 120-B and 379 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the petitioner along with other accused persons are said to have gunned down the brotherin-law of the informant, namely, Surya Narayan and Sanjay Yadav hatching conspiracy over a land dispute with the informant. It has been submitted by learned counsel for the petitioner that there is no specific allegation against the petitioner rather the same are general and omnibus in nature. He has been

One similarly situated co-accused, Dinesh Yadav has been granted bail by a coordinate Bench of this Court in Cr. Misc. No.23252 of 2008 vide order dated 02.09.2008. He has been languishing in jail custody since 26.11.2015.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned 1st Additional Sessions Judge, Saharsa in connection with Sessions Trial No.114 of 2016, corresponding to Saharsa P.S. Case No.169 of 2006.
