The petitioner has renewed his prayer for grant of bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The earlier application for bail of the petitioner was rejected vide order dated 25.4.2022 passed in Cr. Misc. no.66460 of 2021.

As per the prosecution case, 59.4 litres of liquor was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that he is in custody for more than one year since 26.8.2021 and undertakes to cooperate in the trial.

No.54863 of 2022(2) dt.02-11-2022 2/2 Having heard learned counsel for the parties and taking into consideration the liberty granted to the petitioner in the earlier order of rejection dated 25.4.2022 together with the petitioner having remained in custody for more than 1 year since 26.8.2021, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.5227 of 2021 (arising out of Rail Bakhtiyarpur P.S. Case no.37 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna.
