Petitioner apprehends arrest in connection with Complaint Case No. 164 of 2019 registered for the offences under Sections 323, 380, 498(A) and 504 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that there is general and omnibus allegation against the petitioner. It is also submitted in para 4 of the supplementary affidavit that the complainant has solemnized second marriage with one Md. Shabbir and also has

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional Chief Judicial MagistrateI, Benipatti, Madhubani in connection with Complaint Case No. 164 of 2019, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
