The petitioner is languishing in custody since 30.10.2015 in connection with Kaler P.S. Case No. 31 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 504, 506, 307 and 302 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that Umesh Pandey was doing his duty as peon in Aganoor High Court. Due to anxiety of arrest of Pankaj Kumar, a bad tempered man always keep arms with himself in front of School i.e., cousin of petitioner, on 24.06.2015, the petitioner-accused accompanied with others had injured Umesh Pandey with sticks and shot a gun fire into his chest and subsequently he was declared dead on the way of going

Patna High Court Cr.Misc. No.16952 of 2016 (3) dt.23-05-2016 2/2 to hospital.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 30.10.2015 and the charge sheet has been submitted in the case. There is general and omnibus allegation has been made against the petitioner. There is no specific injury has been attributed against the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Kaler P.S. Case No. 31/2015.
