Petitioner apprehends his arrest in a case filed under Sections 409 and 420 of the Indian Penal Code. Petitioner is a Block Agriculture Officer-cum- InCharge of the purchase Centre, Chausa Block. As per the allegation, after purchase of the paddy, petitioner could not send the entire paddy to the rice miller and the paddy remained in the godown of B.S.F.C. and, as such, it had to be auctioned sold as per the direction of the Managing Director and the said auction was made at the lesser side incurring alleged loss of Rs.14,99732.34.

No.16790 of 2016 (3) dt.24-05-2016 2 / 2 It is contended on behalf of the petitioner that this is not a case of misappropriation of fund rather this may be negligence or error made by an employee of the B.S.F.C. for which a decision has already been taken for recovery of such amount.

Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Buxar (M) P.S. Case No.36/16, the above named petitioner, Thakur Prasad Singh shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri S.Ranjan, A.C.J.M.-III, Buxar subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
