This is an application for bail in connection with Rupashpur P.S.Case No. 23 of 2017 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Allegation as per FIR is that petitioner called the deceased on phone and thereafter deceased was killed and petitioner is named in the FIR.

It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case on the basis of suspicion and there is absolutely nothing against him and he is in custody since 27.1.2017 having no criminal antecedent. Heard learned APP and learned counsel for the

Patna High Court Cr.Misc. No.30844 of 2017 (3) dt.21-07-2017 2/2 informant also. Learned counsel for the informant has opposed the prayer for bail stating that deceased was called on phone and he was murdered and further in paragraph-29 of the case diary the witnesses have named this petitioner.

Having heard both sides and considering the facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

Let the trial be expedited and conclude within one year.
