Petitioner apprehends arrest in a case registered for the offence punishable under Sections 364, 34 and 120(B) of the IPC.

The prosecution case in brief is that, petitioner along with other co-accused persons have kidnapped the husband of the informant.

It is submitted that petitioner has been made accused on the basis of unfounded suspicion only because he is relative of co-accused Brajesh Singh. Informant is not eye witness to the alleged occurrence and there is delay of three days in lodging FIR.

Patna High Court CR. MISC. No. 54294 of 2022(5) dt.14-03-2023 2/2 Learned counsel appearing for the State opposes the prayer for bail and submits that the petitioner is named in the FIR and during course of investigation ample evidence has come against petitioner.

Considering the same, prayer for bail of the petitioner is refused with direction to the petitioner to surrender and seek regular bail, which would be disposed of on its own merit without being prejudiced by this order.
