JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner and co-accused Naresh Yadav are said to have been arrested by the police and made their confessional statements leading to recovery of electronic detonators and other explosive substance.

Submission on behalf of the petitioner is that petitioner was picked up by the police on 22.02.2016 from his house and, after that, the wife of the petitioner filed a petition before the learned Chief Judicial Magistrate, Jamui, disclosing the atrocity of the police and, after that, police manufactured this case on the basis of so called confessional statements of the petitioner and other accused and lodged the present case on 23.02.2016.

No.16493 of 2016 (2) dt.26-04-2016 2/2 Moreover, petitioner and other accused were produced before the learned Chief Judicial Magistrate, Jamui on 24.02.2014 and no explanation of the aforesaid delay was given. So far as criminal antecedent of the petitioner is concerned, petitioner has been remanded in some cases only on the basis of suspicion. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in connection with U.A.P.Case No. 14 of 2016 arising out of Khaira P.S.case No. 31 of 2016.
