ANJANA MISHRA ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of O.P. No.3 as well as the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Complaint Case No.C2-158 of 2013 for allegedly having committed the offence under Sections 209, 420, 406, 463, 465, 466, 467, 468, 469, 471, 472 and 474 of the Indian Penal Code.

Mr. Suraj Narain Prasad Singh, learned Senior Counsel appearing on behalf of the petitioner submits that the present case has been initiated on some misconceived notions

Patna High Court Cr.Misc. No.31369 of 2014 (6) dt.21-09-2015 2/2 and that the complainant is, in fact, a concubine of Late Nageshwar Prasad Gupta, who was the uncle of the petitioner and had authenticated the receipt of the compensation amount. While receiving the said compensation amount, the petitioner has undertaken to return if there is a conflict between the parties regarding receipt of the compensation amount. Considering the fact that the petitioner is willing to deposit 50% of the aforementioned amount, which stands with the court as security, subject to the result of the present complaint case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Complaint Case No.C2-158 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
