JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case initially, registered under Sections-307 & other minor sections of the Indian Penal Code, in which, later on, Section-302 of the Indian Penal Code was also added.
There is specific allegation of assault against Kailash Mandal and Ashok Mandal, who are named in the first information report of the present case and so far as petitioners are concerned; they are not named and as per submission, their name surfaced in course of investigation in confessional statement of coaccused. It is further submitted that FIR named accused have already been granted privilege of bail by a coordinate bench of this
Patna High Court Cr.Misc. No.16951 of 2016 (2) dt.28-04-2016 2/2 court.
Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bihpur P.S. Case No. 60 of 2014 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Naugachia (Bhagalpur).
